Terms and Conditions
Rules for using the SmartParking website, products, connected parking devices and related services.
Last updated: 21 October 2026
Please read these Terms and Conditions (“Terms”) carefully before using SmartParking. They form an agreement between you and Hajari Automation, the maker of SmartParking. By accessing or using this website or the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the Service.
Where an Operator has signed a separate written agreement or accepted a quotation with us, that agreement applies alongside these Terms and prevails if they conflict.
1. Interpretation and definitions
- Company (“we”, “us”, “our”) means Hajari Automation, Office 826, Gera’s Imperium Rise, Hinjawadi Phase II, Rajiv Gandhi Infotech Park, Pune, Pimpri-Chinchwad, Maharashtra 411057, India, the maker of SmartParking.
- Service means this website, email and WhatsApp enquiries, and the parking automation software, hardware integration, installation support and related services described on this site.
- Operator means a parking facility, property team or commercial customer using the Service.
- IoT Device means connected hardware such as boom barriers, RFID readers, ANPR cameras, occupancy sensors, printers, POS terminals and controllers.
- You means the individual, Operator, company or other legal entity accessing or using the Service.
2. Acknowledgment
These Terms govern your use of the Service. You confirm that you are at least 18 years old and able to enter into a binding contract. If you use the Service on behalf of a business, you confirm you are authorised to accept these Terms for it.
This website is informational. Browsing it does not create a hardware, software or services contract. A contract is formed only when a quotation, order or written agreement is accepted.
3. Acceptable use
You agree to use the Service only for lawful purposes. You must not:
- Use the Service in breach of any applicable law.
- Submit false, misleading or harmful information by email, WhatsApp or any other channel.
- Attempt to access non-public systems, credentials, devices or data without permission.
- Tamper with, reconfigure, relocate or bypass IoT Devices without our or the Operator’s approval.
- Interfere with the security or performance of the Service, or overload it.
- Reverse engineer, copy, resell or create derivative works from the Service except as allowed by law or a written agreement.
- Send spam, phishing or unauthorised promotions.
- Use ANPR, RFID, CCTV or access data for purposes other than the Operator’s parking management and safety.
4. Enquiries, quotations and orders
- Product and service pages describe typical capabilities. Specifications, quantities, installation, pricing and timelines are confirmed in a written quotation or order for each facility.
- No price, occupancy saving, plate-read rate or customer result is published on this website unless it has been verified for a specific site.
- Email or WhatsApp does not complete a purchase. A contract is formed only when a quotation, order or written agreement is accepted.
- Any service level, warranty or annual maintenance is only as stated in the quotation, order or warranty document.
5. IoT devices and installation
- Installation is done by us or an authorised installer. Ownership and risk in hardware pass as set out in the quotation or order.
- Hardware compatibility depends on the barrier, camera, reader, printer, POS platform and cabling at the site. Exact models are confirmed after assessment.
- Warranty does not cover damage from misuse, tampering, power surges, unauthorised repairs or natural events, except as required by law.
- IoT Devices need power and network connectivity to report data. Readings may be delayed or missing during outages. Occupancy, ANPR and payment accuracy depend on correct installation, placement and maintenance.
- We may send software or firmware updates to fix problems, improve security or add features.
6. Operator responsibilities
An Operator using the Service is responsible for:
- The accuracy of tariffs, authorised lists, staff roles and other records it enters or approves.
- Having a lawful basis to record vehicles, staff and visitors, and telling them how data is used, including signs where ANPR, RFID or cameras are in use.
- Decisions taken using the Service, such as access permissions, fee collection and exception handling.
- Providing safe access, power, network connectivity and space needed to install and run IoT Devices.
- Keeping a manual override available to authorised personnel at the lane.
7. Alerts and records are operational aids
Occupancy views, device alerts, ANPR reads and payment events help Operators run parking. They depend on devices, power, networks and third-party services, any of which can fail or be delayed. The Service does not replace security staff, statutory safety systems or emergency services. In an emergency, call the relevant service directly.
8. Fees and payments
- Fees for hardware, installation, subscriptions and support are as stated in the quotation, order or plan accepted by the Operator. Prices exclude applicable taxes unless stated.
- Invoices are payable by the due date shown. We may suspend non-essential features for overdue accounts after giving notice.
- Where parking charges are collected from drivers, the Operator remains responsible for setting tariffs, refunds and accounting. Payment gateways and POS platforms are used only where that Operator has approved them.
9. Your content
You keep ownership of information you send by email or WhatsApp. You give us a limited licence to host, store and process it as needed to respond to you and as described in our Privacy Policy. You confirm you have the right to share it.
We may use anonymised and aggregated data, which cannot identify any person or Operator, to analyse and improve the Service.
10. Availability and changes
We work to keep the website and Service available, but they may be interrupted for maintenance, upgrades or reasons outside our control. We may add, change or remove features. Features described as planned, custom or coming later are not claimed as live until they are confirmed for a project.
11. Third-party services
The Service may link to or rely on services we do not own, such as Google Fonts, Google Maps, Google Analytics (if you accept), WhatsApp, POS platforms and payment gateways. We are not responsible for their content, policies or practices. Your use of them is subject to their own terms.
12. Intellectual property
The website, software, firmware, design, text, graphics, logos, the SmartParking name and its features are owned by or licensed to the Company and protected by applicable intellectual property laws. You may not copy, modify, distribute, sell or reverse engineer any part of it except as allowed by these Terms, a written agreement, or law. If you send us feedback, we may use it without obligation to you.
13. Termination
You may stop using the website at any time. An Operator may end its subscription as set out in its agreement with us. We may suspend or end access, with notice where reasonable, if you breach these Terms, fail to pay fees, or if required by law. Sections that should survive termination, including intellectual property, limitation of liability, indemnity and governing law, continue to apply.
14. Limitation of liability
To the maximum extent permitted by law, the Company and its suppliers are not liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, data, goodwill, business interruption, property damage or personal injury arising from a missed, delayed or inaccurate read, alert, payment event or device action, or from your use of or inability to use the Service.
Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the 12 months before the event giving rise to the claim. Some laws do not allow certain limitations; in that case our liability is limited to the greatest extent the law allows.
15. “As is” and “as available”
Except as expressly stated in a written warranty, the Service is provided “as is” and “as available” without warranty of any kind, whether express or implied, including fitness for a particular purpose. We do not warrant that the Service will meet every requirement, be uninterrupted or error-free, or work with every device, browser, network or third-party platform. We make reasonable efforts to keep the platform reliable and secure, but no software, hardware or online service is completely free from faults.
16. Indemnity
You agree to compensate the Company for losses, claims and reasonable legal costs arising from your breach of these Terms, your misuse of the Service or IoT Devices, or content you submit, except to the extent caused by our own fault.
17. Governing law and disputes
These Terms are governed by the laws of India, without regard to conflict-of-law rules. If you have a concern, first email sales@societyos.app or WhatsApp +91 99705 30520 so we can try to resolve it informally within 30 days. If it is not resolved, courts in Pune, Maharashtra, India will have jurisdiction, subject to any rights you have under consumer protection law.
18. Severability and waiver
If any provision of these Terms is held unenforceable, it will be applied to achieve its purpose as far as possible, and the remaining provisions continue. If we do not enforce a right, it does not affect our ability to enforce it later.
19. Changes to these Terms
We may update these Terms from time to time. We will post the new version on this page and update the “Last updated” date. By continuing to use the Service after changes take effect, you agree to the revised Terms. If you do not agree, please stop using the Service.
